801 permanent partner visa is an onshore visa, meaning, you can apply for it while living with your partner in Australia.

However, there are certain eligibility criteria you must pass.

  • You must have a conjugal or de facto relationship with an Australian citizen.
  • The relationship should be mutual and exclusive.
  • To apply for the visa, you must have been living together for 12 months on a genuine basis.

309/100 Offshore Visa 

Partner visa 309 is a provisional visa for permanent partner visa 100. You must be outside of Australia while you apply for the visa. Partner visa 309 is a good option for those who don’t have enough evidence for their relationship. You can either get a partner visa 309 or a prospective marriage visa and get to know each other first.

Eligibility: 

  • You must be outside of Australia while applying.
  • You must be married or in a genuine relationship with an Australian citizen.
  • You must have evidence to prove you have been in the relationship for 12 months.
  • You must also prove the genuineness and exclusivity of your relationship. 

Prospective Marriage Visa 300

This visa is for those who are willing to come to Australia to marry their partner. You must be outside of Australia to be able to apply for this visa. 

A prospective marriage visa is a great way if you've found the one but don't have enough evidence to prove your relationship. 

Eligibility:

  • You must have met your partner before and have evidence of a genuine relationship.
  • You married must be scheduled within the 9 months of the duration of the visa.

Love knows no boundaries, but authorities do. Make sure you have proper documents and evidence for the respective visa and no one shall set you apart from your loved one.
