Subclass 309:

The Subclass 309 visa enables a partner or a spouse of an Australian citizen, Australian permanent resident or eligible New Zealand to live in the country for a temporary period. Getting the Subclass 309 partner visa is the first step in getting the permanent Partner visa (Subclass 100). The partner visa is for offshore applicants. The benefits of partner visa 309 are as follows:

  • You can live, work and study in Australia during the time of visa processing

  • Travel to and from the country as much as you want

  • You can access the free English classes offered by the Adult Migrant English program

The subclass 820 and 801 visa:

The Partner visa 820 is a temporary visa that allows you to stay with your partner or spouse for two years within during which you should get the permanent subclass visa 801. The benefits of both 820 and 801 visas are almost the same.

  • Stay in Australia until your permanent Partner visa (Subclass 801) is processed or withdrawn

  • Work in Australia

  • Study in Australia (you won’t receive government support)

  • You can travel to and from Australia without any restrictions

  • You can attend up to 510 hours of free English language classes offered by the Adult Migrant English Program

  • Register in Australia’s public health care scheme, Medicare

Eligibility requirements

There are certain factors which need to be achieved if you wish to get Partner Visa 801 and 820. The Visa 820 & 801 eligibility factors are as follows:

For Subclass 820

  • Status of The Visa: There should be no cancellation or refusal of the visa in the past

  • Sponsorship Details: You and your family member applying for visa 820 must have a sponsor. The government of Australia should accept your sponsorship. The same person should sponsor you at least 2 years after the visa has been granted

  • Age Requirement: You should be above 18 years of age

  • Health and Character Requirements: You should meet the health and the character requirements listed by the Australian government needs to get approval for the partner visa. If the authority requests your extended family member added to the visa to come and undergo the test the respective person must follow the same.

For Subclass 801

  • Visa Holder: You should be a visa holder of either a Dependent Child visa (Subclass 445) or a Partner visa (Subclass 820).

The general guidelines for both visas are as follows:

Outstanding Dues: You should not have any debt registered in your name in Australia. If there is any amount registered in the country you must pay it back before applying for the partner visa.

Best Interest of the Children: If the terms of the visa are not in the best interest of the children the chances are high it will be cancelled.
