Top Tips For New Subclass 482 Visa

Temporary skill shortage visa 482 is a work visa that allows Australian employers to sponsor a skilled person from overseas to work in their enterprise or company in Australia. The new subclass visa was established on 18 March 2018 by replacing the 457 visas. After proposing the speculation, the new subclass 482 Visa came into effect. 

Existing employers can sponsor temporary skilled workers to Australia

Existing Business Sponsors approved under the 457 program can continue their sponsorship to temporary workers for the new 482 visas. Employers don’t need to update their sponsorship approval until it expires, and the renewal process is streamlined for existing sponsors.

Australian employer sponsors can apply for approval as Accredited Sponsors when they meet the new criteria. Low risk, low volume sponsors can gain access to priority processing of Visa 482 as soon as five days with the possibility of auto grants in some situations.

Employers sponsor occupations on the STSOL or MLTSSL list.

The difference between these two occupations is that STSOL occupations are approved for a three-year visa and MLTSSL occupations are approved for four-year visas. Employers should carefully check their 482 skilled occupations listed in the Australian New Zealand Standard Classification of Occupation (ANZSCO). Also, consider other additional special requirements to identify that the occupation is suited to perform the duties.

No automatic transition from the 482 visa to permanent residence

If you want to get permanent residence, the new Tss Visa requires you to follow some steps first. The employees should be on the nominated occupation list of the Temporary Transition Stream and should work for at least three years. Also, they should be under the age of 45 and should be nominated by the current employee. If the applicants satisfy these conditions, they are eligible to transit from 482 visa to PR visa. 

482 visa – Highly skilled workers with qualifications and 2 years of work experience

The 482 visa allows the employees who hold qualifications with the required skill to work in Australia. Also, they should have a minimum period of work experience in the nominated occupation. This prevents employers from sponsoring an international student graduate who lacks work experience. 

Work experience should meet the legislative standards where the appropriately skilled level means post qualification. In addition, the work experience should be full-time in the nominated occupation to ensure they nominate a skilled person. 

Labour market testing exemptions removed for all professional occupations

Labour market testing is required for all occupations except in limited circumstances.  In the previous 457 requirements, many occupations were exempt from Labour Market Testing and needed minimal requirements. Now, for the 482 Visa Requirements, the Labour Market Testing occupation exemptions have been removed. Employers must show that they are using a national recruitment service to advertise for 28 days, containing details of the position and location. Through the new 482 visa, only the skilled workers with the qualification are nominated for overseas work.
